The Partner Visa (Subclass 820/801) allows the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia. This is a two-stage visa process — Subclass 820 is the temporary stage, followed by Subclass 801 permanent residency. Applicants must demonstrate a genuine and ongoing relationship. Once granted permanent residency, applicants gain full work rights and access to Medicare. This visa provides a clear pathway to long-term settlement and Australian citizenship
You must be sponsored by your Australian citizen, Australian permanent resident, or eligible New Zealand citizen partner. Your partner must lodge a sponsorship application at the same time you submit your visa application.
You must be in Australia at the time of lodging your Subclass 820 application and generally at the time the temporary visa is decided.
You may face limitations if you previously held certain regional provisional visas such as: Subclass 475 (Skilled – Regional Sponsored) Subclass 487 (Skilled – Regional Sponsored) Subclass 491 (Skilled Work Regional – Provisional) Subclass 494 (Skilled Employer Sponsored Regional – Provisional)
Both you and your partner must be at least 18 years old at the time of application.
You and any dependent applicants must provide police clearance certificates for countries where you have lived for 12 months or more in the last 10 years.
You and any dependent applicants must complete health examinations through approved medical providers. Even non-accompanying family members may be required to meet health standards.
The combined base application charge is approximately AUD 8,850 (subject to change by the Department of Home Affairs)
Eligible dependent children can be included in the application. Each dependent must meet health and character requirements.
